Can I pay by cheque?

Although our preferred methods of payment are via PayPal, clients who wish to pay by cheque may do so, although there will be a slight delay whilst funds clear.

 

How do I pay for barrister/expert fees?

Barristers fees and other disbursements can be paid by cheque. As these fees are charged "at cost", there will be a 5% handling fee if you would prefer to pay these items by credit card via Motor Lawyers.

 

Refunds

If you withdraw instructions before we have undertaken the work, we will refund your fees as appropriate. If you withdraw instructions before we have discussed the case with you, you will be entitled to a full refund. We attempt to offer complete peace of mind, not only in the advice we give, but the manner in which we operate our service.

 

Why do you not specify a fee for Crown Court cases?

By their very nature, Crown Court offences can be protracted and drawn out, often involving several appearances in the Magistrates' Court before a Crown Court trial. Although Motor Lawyers are happy to deal with such cases, and indeed have particular expertise on death by dangerous driving and similar offences, we prefer to discuss the full merits and details of the case before agreeing a fee. In this way our clients know exactly how much they will be paying, albeit that the charges are outside the set fees quoted above.

 

How do I instruct My brief solicitors/what happens next?

1. Short Questionnaire. My brief Solicitors will send to you a short questionnaire which you will need to complete and return to us via post, email or fax. 2. Paperwork. Where possible either scan in and email or fax a copy of any paperwork you have received relating to the offence and your driving licence. If you have a 'credit card' style licence, we also need to see the endorsement sheet that accompanies it. We will acknowledge the questionnaire promptly by email and provide payment options/details for the service you have requested.

 

Online Payments

For the easiest and quickest method of payment and to ensure security and peace of mind for your transaction, we accept online payments via PayPal. Once you have carried out the transaction, you will receive confirmation from Google or PayPal who will also notify us that payment has been made. Neither will pass to us your financial or credit card details.  

Other Methods of Payment

If you would prefer to pay by cheque, postal order, BACS etc, please email us stating how you wish to pay and we will provide you with the appropriate details. This method of payment is not advisable when urgent action is required as there will be a slight delay whilst funds clear.  Once the above steps have been completed, we will review your documentation and then allocate the file to the most appropriate case handler. We will email you confirming an appointment time to telephone you to discuss your case personally. We will allow sufficient time to discuss the case fully with you and will ensure that you are fully aware of the action that we will be taking and we will also discuss with you any concerns you have regarding the case. We will always confirm our advice in an email and take further action as appropriate for the service you have chosen. However you proceed, you will do so safe in the knowledge that your case has been properly understood and you have received advice that is appropriate for you and your circumstances.

 

What is not included in the fixed priced services?

Our fixed fee service covers all aspects of preparation required to resolve your case but does not include: • Any additional expenses incurred, e.g. experts' reports; • Court costs & fines; • Obtaining statements from other witnesses; • Site visits; • Appeals against any Order/Judgement given in your case.If your particular case requires additional work not included in the fixed fee, then we will liaise with you in order to agree a course of action and a fee as and where appropriate. We attempt to be as flexible as possible so if you have any concerns, please enquire without obligation.

 

Do you provide a No Win No Fee Service/Legal Aid?

We do not undertake work on a no win no fee basis as this is not allowed under the terms of current legislation covering work in the criminal courts. However, if your case is successfully defended, we will attempt to recover your costs from central funds and will refund to you all costs allowed by the Court. Likewise we do not undertake work on a Legal Aid basis. If we believe that your case is suitable for Legal Aid, we will advise you accordingly.

 

Is VAT included?

The fees quoted on our website exclude VAT, which will be charged in addition, at the appropriate rate. If you require a VAT invoice, we will email this upon request.  

Why do I have to pay VAT?

We are required by law to charge VAT on all our services.  

How quickly can you respond?

We would normally acknowledge your enquiry immediately and we aim to telephone you to discuss your case as soon as we have received your documents and confirmation that your payment has cleared. We deal with cases on a first come first served basis. If we cannot telephone you at the exact time that you have requested, we will email you to suggest an alternative time.  

I am in court tomorrow - can you help me?

Obviously the more notice we get the better, as there are often many aspects of the case that require full preparation well in advance of the hearing. However we attempt to be as flexible as possible. If we can give urgent assistance we will do so, although, on occasions, it may be difficult to obtain instructions and arrange/instruct a Barrister to represent you, particularly if you allow less than 24 hours before your hearing date. Whilst My brief Solicitors are open until 10 pm, not all of the Barristers that we instruct can be contacted at such short notice.

 

Who will deal with my case?

My brief Solicitors will always allocate the most appropriate person to assist you. Our staff have extensive knowledge of all areas of motor law with specialist knowledge ranging from construction & use, drink driving, speeding, death by dangerous driving etc. Once allocated, your representative will see the case through from start to finish.  

What if I want to change my plea as the case progresses?

When we discuss the case with you, we will give you our best advice in relation to your plea, tactics and how to proceed. If, having considered that advice, you decide that you wish to change your plea, we will proceed in accordance with your instructions and will obviously present the best case we can. You may change your plea as the case progresses but clearly, the advice we give is done so only after we have considered the matter fully. It will be what we believe to be the best course of action.

 

How can I find out what is happening on my case?
