MyBrief Terms of Service
These Terms are an agreement between you and FYP LLC ("MyBrief," "we," "us"), which operates MyBrief, including the website at mybrief.com, our emails, and your dashboard (together, the "Service"). By signing up for or using the Service, you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Service.
Please read Section 14. It requires most disputes to be resolved through individual arbitration instead of in court, and it waives class actions. You can opt out within 30 days.
1. Who can use MyBrief
You must be at least 16 years old. You need to use an email address you control. You're responsible for keeping that email account secure, because anyone with access to it can sign in to your dashboard. Each reader should have their own subscription.
2. The Service
MyBrief is a daily email about AI, personalized from what you tell us about your work, plus a dashboard for your past issues, saved items, and your brief.
- MyBrief is in an early release. Features may change, break, or be removed, and we may pause or discontinue the Service at any time.
- By signing up, you agree to receive your daily issue and service emails, such as sign-in links and account notices. You can unsubscribe at any time using the link in any issue.
- If we offer paid features, we'll show you the price and any extra terms before you buy. We'll never charge you without your explicit agreement.
3. AI-generated content
Issues are researched, written, and assembled with the help of AI models and automated systems. That means:
- Content can be incomplete, out of date, or wrong, even though we work to keep it accurate.
- Nothing in MyBrief is legal, financial, medical, tax, employment, or other professional advice. Verify important information yourself, and with a qualified professional where appropriate, before relying on it.
- Tool scores, rankings, and recommendations are opinions based on the data available to us. They are not guarantees about any product.
- Review any prompt, workflow, or tool we feature before using it on your own data, accounts, or systems. You're responsible for how you use it.
If you believe something we published is inaccurate, email [email protected]. We review correction requests and fix errors we confirm.
4. Third-party tools, links, and sponsors
MyBrief covers and links to products, websites, and services we don't own or control. We aren't responsible for them, and your use of them is governed by their own terms. Mentioning a product is not an endorsement. Sponsored content is clearly labeled, and sponsors don't control our non-sponsored content. Some links may be affiliate links, which means we may earn a commission if you buy something, at no extra cost to you.
5. Your content
"Your content" means what you give us: signup answers, context in your dashboard, replies to issues, saved items, and feedback.
- You own your content.
- You give us a worldwide, non-exclusive, royalty-free license to store, copy, and process your content to operate, personalize, and improve the Service, as described in our Privacy Policy. This license ends when you delete your reader data, except for aggregated or de-identified information and copies we're legally required to keep.
- If you send us ideas or suggestions about MyBrief, we can use them freely with no obligation to you.
- Only share information you have the right to share. Don't send us other people's sensitive personal information, passwords, or confidential information you aren't permitted to disclose.
6. Our content
MyBrief, including its issues, design, software, brand, and data, belongs to FYP LLC and its licensors and is protected by intellectual property laws. We give you a personal, non-transferable license to read and use MyBrief for your own personal or work purposes.
- You can use prompts, techniques, and workflows from your issues in your own work, including commercial work.
- You can forward an individual issue. Links in your issues are personal to you, so anyone you forward an issue to may be able to use those links to access your dashboard.
- You may not republish, resell, or redistribute MyBrief content in bulk, or present it as your own.
Our name, logos, and branding are our trademarks. Don't use them without permission.
7. Acceptable use
Don't:
- Scrape, crawl, or bulk download the Service, or use it to build a competing product or dataset
- Use MyBrief content to train or improve AI models
- Reverse engineer, probe, or interfere with the Service, or try to get around security or usage limits
- Sign up with fake or other people's email addresses, create accounts in bulk, or use automation to sign up or interact with issues
- Send content designed to manipulate our AI systems, or any malicious code
- Use the Service to break the law or infringe anyone's rights
8. Referrals and promotions
We may run referral programs, rewards, or other promotions. We set the rules for each one and can change or end them at any time. Referrals only count for real people who sign up and complete their profile. We may withhold or remove rewards for self-referrals, fake accounts, or other abuse.
9. Ending the Service
You can stop at any time by unsubscribing or by deleting your reader data in Account & preferences. We may suspend or end your access at any time, including if you break these Terms, for legal or security reasons, or if we discontinue the Service. Sections that by their nature should continue, including ownership, disclaimers, limitation of liability, indemnity, and dispute resolution, survive after your access ends.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT CONTENT WILL BE ACCURATE OR COMPLETE, OR THAT ISSUES WILL ARRIVE ON TIME.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FYP LLC AND ITS MEMBERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR YOUR RELIANCE ON ITS CONTENT. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF $50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
Some places don't allow these limits, so they may not fully apply to you. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.
12. Indemnity
You agree to defend and indemnify FYP LLC against claims, losses, and costs, including reasonable legal fees, arising from your breach of these Terms, your content, or your misuse of the Service.
13. Governing law
These Terms are governed by the laws of the State of Wyoming and applicable US federal law, without regard to conflict-of-law rules. Any dispute not subject to arbitration will be heard only in the state courts in Fremont County, Wyoming, or the federal courts for the District of Wyoming, and you and we consent to jurisdiction there.
14. Dispute resolution and arbitration
Talk to us first. Before filing any claim, email [email protected] with your name, your email address, a description of the dispute, and what you're asking for. We'll both try to resolve it informally for 60 days.
Arbitration. If we can't resolve it, you and FYP LLC agree to resolve any dispute relating to these Terms or the Service through final, binding, individual arbitration, except as described below. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and, where applicable, its Mass Arbitration Supplementary Rules. Fees are paid as those rules provide. The arbitration may be conducted by video, phone, or written submissions, or in person in the county where you live. The Federal Arbitration Act governs this section.
Exceptions. Either party may bring an individual claim in small claims court. Either party may ask a court to stop infringement or misuse of intellectual property.
No class actions. You and we may bring claims only on an individual basis, not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not combine more than one person's claims, except as the AAA's mass arbitration rules allow. If this waiver is found unenforceable for a particular claim, that claim, and only that claim, must be brought in court under Section 13.
Opting out. You can opt out of arbitration within 30 days of first agreeing to these Terms by emailing [email protected] with the subject "Arbitration opt-out," your name, and the email address you signed up with.
Changes. If we change this section, the change won't apply to disputes that arose before it.
15. Changes to these Terms
We may update these Terms. If a change is material, we'll notify you by email before it takes effect. If you keep using the Service after a change takes effect, you accept the updated Terms.
16. General
- These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
- If any part of these Terms is unenforceable, the rest stays in effect.
- If we don't enforce a provision, that isn't a waiver of our right to enforce it later.
- You can't transfer your rights under these Terms. We may assign these Terms, for example to an affiliate or as part of a reorganization, merger, or sale, with notice to you.
- We aren't responsible for delays or failures caused by events beyond our reasonable control.
- You agree that electronic notices satisfy any requirement that communications be in writing.
